Notary Acceptor and Document Processing Services

UPDATE AND OPTIONS NOT IN CURRENT DOCS AND COURSE - after some review of many student's recent process, we are suggesting these revised guidelines.

These updates can save you time and money over the original instructions, and will simplify the document process. Even though you can decide to not use a "Notary Acceptor" (NA) in most processes now.  You may establish stronger evidence by using a NA, if you end up with a court case (which is you OPPORTUNITY to win).  However you can also have any recorded docs recorded by a local Notary a local notary and/or a PROCESS SERVER. Then docs may have good standing if needed (in court).  This method will also save you time and money on the entire process.

  1. RESPA/TILA letters are optional, and can be sent direct to lenders using certified mail (vs Notary Acceptor process).  
  2. Phase 1 and Negative Averments, can now also send directly by you via certified mail. As far as RECORDING Phase 1 docs, that can now wait until a court case is pending, then it will be admissible. Often recorders do no allow recording the Phase 1 docs until then. In any case, use a NOTARY and/or Process Server to record your documents.  This will give docs enough standing with the court to overcome not using a Notary Acceptor on each document.
  3. Phase 2 can simply be certified mail (but have your signatures witnessed by a notary at least), and do your own direct recording (or use a Paralegal to go in and record some of it).  We now suggest using the court action (suit or counter claim) process to get a judge to rule on this for you as well, to enforce it.

These online recording sites below are for recording misc. document you create, when local courthouses will not record them. Record anything you produce on one of these sites.  However, property related docs such as deeds, reconveyances, and other property lien specific docs will have to be recorded locally to be in effect – such as POA, trustee replacements, quit claims and warranty deeds, liens, reconveyance docs, etc.  

It has been found helpful to have a local Notary or Process server record documents if you encounter issues.

BE SURE to review the manual and consult with a local recorder with a friendly review of their procedures and regulations well before your first recording.  This may help you avoid common problems. 

ALWAYS record all relevant documents with the court, before you may before going into court – as your court evidence (especially summary Affidavits and/or complaints). Your online recorded documents can then be referred to in other document filings you may do later (ie: see www.youonlinelink.com). This may help when you get stuck with stubborn local recorders who won't record documents as required by law.
